Terms and Conditions

1. Send an email, call or whatsapp LM Marine Ltd to check the yacht availability.

2. 50% deposit payment to confirm the booking while the balance payment is due in 7 days before the charter.

Terms and Conditions:

1. Booking Confirmation

For confirmation of reservations, 50% deposit must be settled by the charterer with a payment receipt. The balance must be settled 7 days before the charter. If booking is made less than 7 days before the charter, a full payment is required.

2. Cancellation or Rescheduling

Any cancellation and rescheduling must be notified at least 14 days before the charter day. No refund or rescheduling is allowed if notifying us within 14 days from the charter day.

If the charterer requests cancellation of the reservation, the deposit is non-refundable.


3. NoShow

The company would consider the charter as cancelled after 2 hours of no show. If there is no further instruction from the charterer, the launch would be regarded as cancelled.

All agreed payments must be paid by the charterer. If the charterer requests to return to the destination before the appointed time,  

no compensation for the remaining time will be given. The extra-hours will also be charged accordingly if the over-time run is not requested before the charter.


4. Catering Reservation

Catering and drinks packages must be placed and confirmed at least 7 days before the Charter day, once it is confirmed no change and no refund is allowed.

When charter cancellation or postponement occurs, our company will cancel reservations for refreshment. However, if the catering company has already prepared the refreshments then cancellation is not possible, the charterer will need to collect all the provisions at the appointed time and place and settle the payments accordingly.


5. Primary Contact Person

We are responsible for communicating with the primary charterer who organized the charter only, other parties have no right to change any information unless the primary charterer notified us and agreed in advance.

6. Boarding Information

A Boarding Information will be sent by LM Marine Ltd in form of a whatsapp message to the Charterer 1 day prior to the charter including the Yacht number, Captain contact, number of passengers, Boarding Pier, Destination and Boarding date and time. If any special arrangements, the charter must discuss with the company beforehand since there might incur additional charges.


7. Numberofpassengers

The charterer is liable and responsible for exceeding the licensed or the agreed number of the passengers in all circumstances and the vessel should only sail within Hong Kong water, otherwise, the coxswain reserves the right not to sail the vessel.


8. The Safest Route or Itinerary

Due to rough weather or security reasons, the Captain reserves the right to choose a safer route and another destination for boarding. The charterer must board and disembark the vessel at the same pier. The charterer should also inform the company in advance in case of any special arrangement.


The Captain reserves the right to return to the pier immediately in case of any neckless or dangerous behavior of the charterer including his or her guests. Meanwhile, for safety reasons, the Captain has the sole right to make decision on board if the behaviors of the charter and the guest is in danger, the Captain reserves the right to control the sound level of music playing on the charter or to return to the shore immediately.


If there is a change in the weather, the captain has the right to choose the safest route to a destination and/or safe location to dock.


9. Chartering Period

The company would count charter time from the time. The craft waits upon the charterer (inclusive of such time the craft lines up for embarkation) until the last member of the charter party left with all their personal belongings.


Any extra charter hours are subject to overtime charges, which is calculated per hourly Double rate, should be settled prior to the Charter date, directly to LM Marine Ltd. The Crew should not be responsible for any Extra hour payments.


10. Damage of Furniture and Equipment

The charterer should ensure all furniture and equipment on board is in the best condition. The charterer will be responsible for any damage caused by any of his/ her party members. All equipment and facilities should be used under any applicable regulation of Hong Kong or used under proper instruction.


The person in charge or the primary charterer will be responsible for the vessel on the date of the launch. The Primary charterer should hold the sole responsibility and compensate for any damages if there is any damage or injury caused by the violation of such rules.


11. MalfunctionofEngine

If the engine fails before sailing and cannot be repaired before launching, the company will inform the charterer as soon as possible and a replacement of another boat will be provided. However, If no boat is available, the charter rescheduling will be guaranteed within the next 6 months from the original charter date, but all catering or drinks fees booked will be at the charterer’s cost.


If the engine fails accidentally during sailing, the vessel should return immediately by all means. The chartering time will not be compensated by the company if the charterer has enjoyed half of the chartering time or it has already reached the destination.


In case any compensation launch could only be arranged on a weekday.

12. LifeorInjuryorChildrenCareResponsibility

All vessels are insured according to the law of Hong Kong. The charterer will solely carry the responsibility for the passengers and passenger’s property.


Neither our company (agent) nor any of the officers, servants or agents nor any vessel shall be reliable for any loss or damage to property, loss of life or personal injury whether through negligence or any other cause while on board of any craft, boarding or disembarking from any vessel or other activity and whenever. Our company will not hold responsibility for any loss or damage but would report those to the Police of Hong Kong.


Passengers should be responsible for their personal safety, personal belongings, any property they bring on board. In case of any lost of personal belongings, any life or any property, our company, the yacht owner or The Captain and Crew will not be responsible for.


Children is the sole responsibility of their parents / guardians. We do not provide child care service during the charter. It is advisable for at least 1 adult to look after 1 to 2 children fully during the chartering.


13. Typhoon or Bad Weather

The followings will be applicable in case of typhoon:


a. The vessel will still set sail when typhoon signal no. 1 or rainstorm red warning is hoisted. There will be no cancellation or postponement even if a higher typhoon signal is lowered to typhoon signal no.1 nor rainstorm black warning is lowered to rainstorm red warning two hours before the appointed departure time. When the charterer requests to postpone the launch, the re-scheduled launch would only be on a weekday no matter if the original departure date is on a weekday or a weekend. The charterer is also advised to keep close contact with our company.


b. If a typhoon signal no. 3 or higher or rainstorm black warning is hoisted while sailing, the Captain could choose to sail the vessel back to the closest pier according to the Marine Ordinance and Safety. No compensation will be given in such situations.


c. If a typhoon signal no. 3 or higher or rainstorm black warning is hoisted at seven o’clock in the morning or before launch, the charterer will postpone the schedules launched on that day. No refund is allowed.


d. If the departure date is rescheduled due to the typhoon signal no. 3 or higher, the postponed itinerary would still be rescheduled on a weekday within 6 months if the original launch date is on a weekday.


In case the original date of the scheduled itinerary is on a Sunday, public holiday or on a Saturday, the rescheduled date would be on any non-public holiday or a week day or the same kind of date after September in the same year. All documents should be sent to the company for date changing within one week, the company will consider the launch cancelled for any delay and the payment is non-refundable.


e. If the craft cannot reach the appointed boarding pier, the charterer should board from the suggested pier. Our company will only compensate all the traveling expenses between the appointed and suggested pier.


14. No Drugs Allowed

No Drug nor illegal substances is allowed on board; once discovered, it will be reported to Police immediately, and NO Refund & Claims for the charter.

15. The Most Updated Version

In the case of dispute on the terms and conditions, the newest and correct version from LM Marine Charters website automatically overwrites the old version without any notice.


16. Water Sports Safety and Insurance

I take responsibility for and am in charge of the water activities this day, I have read and understood such water activities (eg. wakeboarding/ wakesurfing, banana boat, jetski, floating slide, swimming ring, trampoline, stand up paddling, kayaking, seabob, e-foil etc.) possess a certain risk. In order to avoid accidental injuries/ casualties and property damages, I and all participants must follow all instructions and regulations of such activities.


LM Marine recommends that the person in charge of chartering the yacht separately purchase water sport safety insurance for his/her group of members.


17. HKSAR Government Requirement to COVID 19

Due to the restrictions imposed by the HKSAR Government in response to COVID19, the charter may be prohibited from the original booking date, the charter needs to reschedule the booking as per the following terms:


• When the charter date is on weekday, the rescheduled day must also be on weekday. When the charter date is on the weekend, the rescheduled day must also be on the weekend.


• Any difference in the charter charge between the original charter date and the rescheduled day will not be refunded.


• The Charterer may only reschedule the charter date once, such arrangement to be within 6 months from the original charter date. If the charterer has not rescheduled within this period of time, the charterer will be deemed to have forfeited 100% of the charter fee.


• When rescheduling due to the forthcoming, any change of vessel is not accepted.


• Unless or otherwise listed under these terms and conditions, we will not accept any request for refund.


18. A Coordinator

LM Marine Limited is a yacht sharing platform that aims to improve the safety of sailing fairly and reasonably. We play a role as an intermediary to coordinate and handle charter affairs between the lessors and the clients, and follow the laws of Hong Kong.


In the event of a major accident during the charter period, such as natural disasters, or man- made disasters, the company will assist both parties in the negotiation as a coordinator, but neither the company nor the yacht owners shall bear any legal responsibility.
